By accessing or using Visual Sentinel ("the Service"), operated by Acefina SMC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). Visual Sentinel is a product and trademark of Acefina SMC. If you disagree with any part of these terms, you do not have permission to access the Service.

Visual Sentinel provides website monitoring services, including but not limited to:

• Uptime monitoring and availability checks
• Performance monitoring and response time tracking
• SSL certificate monitoring and expiration alerts
• DNS monitoring and change detection
• Visual regression testing and screenshot comparison
• Alert notifications via email, SMS, Slack, and other channels
• Status pages and incident management

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old or have the legal capacity to enter into a binding agreement to use our Service.

Free Trial: We offer a 14-day free trial with full access to features. No credit card is required to start the trial.

Paid Plans: After the trial, continued use requires a paid subscription. Payments are processed monthly through our payment processor, Paddle.

Billing: Subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method for all fees associated with your subscription.

Price Changes: We reserve the right to modify pricing with 30 days' notice. Existing subscribers will be notified via email before any price changes take effect.

You agree not to use the Service to:

• Monitor websites you do not own or have permission to monitor
• Conduct denial-of-service attacks or excessive load testing
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Resell or redistribute the Service without authorization

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice when possible)
• Emergency maintenance or security updates
• Factors beyond our reasonable control

Enterprise customers may have specific SLA guarantees as outlined in their separate agreement.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

You retain ownership of your data. We claim no ownership rights over the monitoring data, configurations, or content you provide through the Service.

The Service, including its original content, features, and functionality, is owned by Acefina SMC and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Visual Sentinel is a registered trademark of Acefina SMC. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

To the maximum extent permitted by law, Acefina SMC shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your data
• Service interruptions or downtime
• Actions of third parties

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted. We do not guarantee that monitoring results will be 100% accurate or that all website issues will be detected.

By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in prohibited activities.

Upon termination, your right to use the Service ceases. You may request export of your data within 30 days of termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
